Legal nurse consultants play a crucial role in medical malpractice cases. Medical Malpractice is the professional negligence by a health care provider that directly leads to physical and/or economic damages of an individual.
Legal nurses assist attorneys by researching and defining the acceptable Medical and Nursing Standards of care and regulatory requirements that are essential to a favorable outcome for the attorney and his/her client. By hiring and collaborating with me as your Legal Nurse Consultant at the beginning of the litigation process, my experience and expertise can prove invaluable to you in recognizing the strengths and weaknesses of your cases from a medical perspective.
Medical Malpractice cont…
A legal nurse consultant’s work is time saving and cost-effective in the litigation process. As a legal nurse consultant, I can provide an insider’s view on the practice and procedures of the health care industry, as well as, an in-depth understanding of the medical facts and patient care issues. As your Legal Nurse Consultant, I can help you with understanding deviations from and adherences to the standards of care, evaluate the damages, identify factors that caused or contributed to the alleged damages and/or injuries, locate appropriate experts for each individual case and interpret key medical information for you. I will provide you with a professional, honest and insightful approach of identifying issues and a simple, practical way of explaining the complexities of a case.
Wikipedia defines Personal Injury as “an injury, to the body, mind or emotions”. This injury is the result of negligence or wrongdoing of another person or company.
As both a Legal Nurse Consultant and nurse, I am better equipped to read and interpret medical records than many attorneys. I can identify significant clinical information and key factors in the medical records that may be missed or overlooked by the attorney, as I am used to medical terminology, abbreviations and deciphering physicians’ handwriting. My expertise in analyzing, interpreting and summarizing medical records strengthens your case for justice and ensures a successful resolution.
Nursing Home Litigation
Due to the complexities of nursing home litigation the Legal Nurse Consultant needs to be strategic in assisting the attorney in case development. There are many intricate areas to consider from allegations of abuse or neglect to falls, medication errors, malnutrition, pressure ulcers and wrongful death to name a few. Having worked in several nursing homes as both a nursing assistant and later as a nursing supervisor, I am familiar with many of the challenging issues that occur in this setting. As a result, I will collaborate with attorneys by defining the Standards of care and identifying key areas that may have been substandard or caused the alleged allegations.
A workplace injury is an injury that occurs on the job and as a direct result of the duties assigned to a particular job position. Workplace injuries are not always easy to prove, especially when an injured employee has prior medical conditions that may appear to have been the cause of the injury.
As your legal nurse, I can look at all past medical records that are pertinent to the claim in order to determine if the claim has any merit to it. Then I can prepare a report of my findings to help prepare the attorney for pursuing the case further. I can also help with deposition questions and finding any expert witnesses pertinent to the case.
Forensics is a fairly new aspect of legal nurse consulting. Forensic legal nursing is different from your typical legal nurse consulting, as it incorporates analysis and investigative principles in order to assist the attorney in determining what happened by looking at the history provided, any medical information and the circumstances that may have led to the alleged crime.
At this point, my focus is more to help attorneys become aware of how a legal nurse can assist them with their criminal cases. First, I would like to increase your awareness of various medical injuries that are common in criminal cases by providing a power point presentation to your firm. Examples of some common medical injuries would be child abuse, sexual assault/abuse, strangulation or death.
With so many products on the market today, it is a known fact, that from time to time there will be an issue with the safety of one or any of these products. Product manufacturers have a responsibility to the consumer both ethically and legally to ensure that their products are safe. The legal rules regarding who is responsible for dangerous or defective products, is different from customary injury law, and this set of rules can sometimes make it easier for an injured person to recover damages.
As your legal nurse, I can save you time, by helping interpret any medical records significant to the injury, researching authoritative, unbiased reports and putting the puzzle pieces of your case together by writing reports and preparing deposition questions that are pertinent to your case.read more
